裝潢訂金被扣了

事情是這樣的,我的裝潢採設計施工分開,因為統包急著找我簽約,拿出一份估價表讓我簽,並說等設計圖出來他可以按圖施作,不會追加預算。

可事實卻不是這樣,等到設計圖出來了,統包千方百計希望我改設計,我表明立場不願意,他便說要按圖施作要追加20萬預算,我認為跟當初協議的完全不同,所以跟他說要結束合作關係。

估價單上的議價185w是他用原子筆寫上去的,裡頭沒有提到訂金的事,請問各位專業的大大,扣除拆除、廢棄清運,訂金有可能拿回來嗎?
如果上法院,有勝算嗎?
